TERMS & CONDITIONS

  

 GENERAL

The Terms and Conditions of trade of RightWay Plant Training are contained herein.


These Terms and Conditions will form the basis of all contracts with RightWay Plant Training, unless

otherwise specified in writing. All bookings should be confirmed by the Client to RightWay Plant

Training in writing and accompanied by a payment. 


RightWay Plant Training reserves the right to vary these terms and conditions at any time and

without notice, the latest version of which will be available via the web site or at the request of the Client.

  

PLANT, EQUIPMENT & PPE

The plant and equipment presented for training must be serviceable in all respects. All lifting appliances and accessories must be in good condition and where necessary have current test certificates.

Training should be carried out in a section isolated from working areas and clearly marked. We reserve the right to refuse training if the conditions are not met. Please note: In this instance the full course fee will be charged.

 

Certain courses may necessitate special requirements which will be discussed before course commencement.

Candidates must have suitable PPE with them for any tests. You must have Safety Boots, Hard Hat and Hi-vis Vest.

  

PERSONNEL

The course involves the operating of equipment therefore candidates must report for training, rested and not under the influence of alcohol or drugs. If candidates are taking medication that may affect their ability, we must be informed. We reserve the right to refuse to train any person considered unfit to operate equipment. There will be no refund in this case.

  

DATA   PROTECTION

The customer agrees that we are permitted to hold personal information about delegates as part of our personnel and other business records and we are registered and comply with the  Data Protection Act.

  

FORCE MAJEURE

If we are unable to provide any course, or any part of any course, for any reason beyond our reasonable control, we shall be entitled to postpone or cancel that course, or part of it. The Company shall try to agree with the customer an alternative mutually acceptable date and/or time to provide the postponed/cancelled training but shall be under no obligation to do so. If no appropriate agreement can be reached on rescheduling such training, we will make no charge for the cancelled training and if paid in advance we will refund the cost of it to the Customer.

  

NVQ BOOKINGS

A deposit will be required to be paid to RightWay Plant Training upfront to cover any registration fees and to secure test /training dates.

Balancing payments will be due for payment by the date stated on the invoice.

After payment of NVQ Registration fees, a pre course induction will take place. 

Following completion of a pre-course induction, the timeframe given for any training to prepare for an assessment is a guideline depending on the ability of the candidate. Some candidates may require more or less days training than quoted.

The timeframe for training given relates to RightWay Plant Training’s instructor only. 

RightWay Plant Training is not responsible in the event that a candidate carries out training elsewhere and finds that the training has not prepared them for the test, or results in a failed test.

Candidates must provide us with the exact details. 

- Full Name

- Date of Birth

- National Insurance Number 

- Home Address & Postcode

- Contact telephone number 

- Email Address

 

PLANT NVQ’S

All NVQ registrations will be processed once payment has been received.

​

In order to process an NVQ registration, RightWay Plant Training requires the candidate's Full Name, Date of Birth, CPCS Number, National Insurance Number, Contact Telephone Number, and Home Address. 

Failure to provide all details requested will result in the NVQ registration being delayed.

​

Any extension cards and blue cards will be sent to the address provided unless RightWay Plant Training is notified to send it elsewhere.

It is the responsibility of the candidate/employer to notify RightWay Plant Training of any change of address. In the event that RightWay Plant Training has not been informed of a change of address and this results in a card being sent to an address the candidate no longer lives at, the candidate/employer must pay a fee of £35 +VAT for a replacement card to be sent to the correct address.

  

NVQ CANCELLATIONS & REFUNDS

In the event that a site visit with the Assessor is cancelled less than 48 hours before the date a fee may be charged.


In the event a refund is requested after a candidate has already been registered for the NVQ, a partial refund will be given (minus fees and any card extensions that have been issued).

In the event a refund is requested before a candidate has been registered, then a full refund will be issued.


Cancellations must be made at least 48 hours before the arranged date of a site visit.

In the event a site visit is cancelled without giving any notice, i.e., if the candidate fails to turn up

without any communication, a fee will be charged and must be paid before the NVQ is completed.

  

NVQ - CERTIFICATION

All certificates will be sent out to candidates once full payment has been received.


It is also the responsibility of the Individual/Employer to ensure they have allowed enough time to for the NVQ to be completed before the extension card expires. It can take up to six weeks for a blue card to arrive once RightWay Plant Training has submitted a card application.

Once card applications are submitted, RightWay Plant Training holds no responsibility for individuals who are refused access to site due to possessing an expired card.

​

RightWay Plant Training holds no responsibility for certificates/cards lost in postage. Candidates must inform RightWay Plant Training if they have not received their certificates/cards at the earliest opportunity, or they may be charged for a replacement.

All cards and certificates will be sent to the address provided unless RightWay Training is notified to send it elsewhere.


It is the responsibility of the candidate/employer to notify RightWay Plant Training of any change of address. In the event that RightWay Plant Training has not been informed of a change of address and this results in a card being sent to an address the candidate no longer lives at, the candidate/employer must pay a fee of £35 +VAT for a replacement card to be sent to the correct address.     

  

NVQ PAYMENTS

A deposit will be required to be paid to RightWay Plant Training upfront to cover any registration fees and to  secure test dates.


Balancing payments will be due for payment by the date stated on the invoice.

If an invoice becomes overdue then we may charge interest on the balancing payment. 


Where training is due to take place within 5 days from commencement, payment must be made in full in advance.

​

Where an invoice is not paid by the due date, RightWay Plant Training reserves the right to cancel the course at any given time before or after the course/test start date. In the event of a retainer being paid in advance, this will be non-refundable if RightWay Plant Training is forced to cancel the course/test.

​

All certifications will be held by RightWay Plant Training, and in some cases the results will not be submitted until all fees are settled.

​

Invoices are subject to VAT at the appropriate rate, except for customers with VAT exemption, in which case proof of VAT Exemption must be provided.

​

Invoices are payable via bank transfer, BACS or cash.

NPORS - ON SITE REQUIREMENTS

For courses taking place on site, it is the responsibility of the customer to ensure their site meets the requirements set out by NPORS.

​

If on the day of the course/test, the Instructor deems the site unsuitable for the course/test to be carried out, RightWay Plant Training reserves the right to cancel. If this is the case, RightWay Plant Training course will be re-scheduled once free of charge. If the instructor deems the site to be unsuitable for the second time then a charge will be issued to cover the administration, machine and instructor costs.

  

NPORS – CANCELLATION   & RESCHEDULING

Cancellations made 5 working days hours before tests/course

Notice of cancellation for all NPORS courses and tests must be given no less than 5 working days in advance of the course/test date.  In this case a full refund will be given


Cancellations made less than 5 working days before tests/courses – Your right to cancel

We understand that for reasons out of your control, occasionally candidates need to cancel a test at the last minute. In this instance if a test is cancelled after the 5 working day notice period, a refund will be given, however you will incur an administration fee, any fees for machine costs and fees for instructors.


Giving No Notice

If the test/course is cancelled without giving any notice, i.e., if the candidate fails to turn up without any communication, no refund will be given.

Refunds will be made by the same means you paid it.


RightWay Plant Training’s Right to Cancel

RightWay Plant Training reserves the right to cancel, including cancellation on the day of the course, if the Test location experiences a problem outside their control. This includes but is not limited to: electricity failure, security alert, extreme weather. In such circumstances you will be offered an alternative test date.


Rescheduling

If you wish to reschedule a test for another date, you MUST do this at least 5 working days before the scheduled test/course date.  There will be no charge for rescheduling the test before the 5 working day penalty period. Any tests rescheduled after the 48-hour notice period will incur a booking fee, fees for machine costs and Instructor fees.

CANCELLATIONS &   RESCHEDULING


Cancellation

RightWay Plant Training has a 5 working day notice period for all cancellations and rescheduling.

Cancellations made 5 working days before a course

Cancellations must be made no less than 5 working days before the course. In this case a full refund will be given.


Cancellations made less than 5 working days before a course – Your right to cancel 

We understand that for reasons out of your control, occasionally candidates need to cancel a course at the last minute. In this instance if a course is cancelled after the 5 working day notice period, a refund will be given, however you will incur an administration fee, any fees for machine costs and fees for instructors.


Refunds will be made by the same means the funds were paid.


Giving No Notice 

If the course is cancelled or if there is a ‘no show’ without giving any notice, i.e., if the candidate fails to turn up without any communication, a fee will be payable.

RightWay Plan Training reserves the right to cancel, including cancellation on the day of the course if the Test location experiences a problem outside their control. This includes but is not limited to: electricity failure, security alert, extreme weather. In such circumstances you will be offered an alternative test date.

Rescheduling

If you wish to reschedule a course for another date, you MUST do this at least 5 working days before the scheduled course date.

Any course rescheduled after the 5 working day notice period will incur a booking fee, fees for machine costs and Instructor fees.


There will be no charge for rescheduling the test outside the 5 working day penalty period.

Course dates, start times, required equipment, and directions to the training centre will be detailed on the course Joining Instructions.     


RightWay Plant Training will take no responsibility for the candidate's failure to read the joining instructions properly.

DATA   PROTECTION & PRIVACY

All personal data provided to RightWay Plant Training will be handled in accordance with the Data Protection Act 2018.


RightWay Plant Training may collect information on candidates for booking of tests and courses only, we may also collect feedback or comments to help improve courses and tests.

​

With permission of the candidate, some comments may be used on the website or social media for testimonial purposes only. A separate form is provided giving RightWay Plant Training permission to use or publish any comments. Any candidate who doesn’t wish for any of their comments to be published should ensure they do note sign the form.


RightWay Plant Training will not pass on data to third parties for marketing purposes.

Candidates have the right to request a copy of the personal data RightWay Plant Training holds for them and can correct any inaccuracies found (a small fee may apply).
